    Presentation Topic: 2022 Legislative Update

    Speakers will discuss new employment laws effecting Florida employers, as well as discuss the impact of the November 2022 election on pending and new legislation and regulatory activity.

    Attendees will learn important information about new laws and regulations affecting human resources in order to reduce potential litigation and increase risk-management controls. 

    About the Speakers:

    Scott Atwood Melany Hernandez

    Scott is Chair of the firm’s Labor and Employment Law group. From complex labor and employment counseling and litigation to general business matters, he has been representing the interests of entrepreneurs, public entities, and businesses of all sizes throughout the United States, including Florida and Georgia, for more than 25 years.
    More specifically, Scott has extensive experience in all aspects of employment law, including Title VII, ADA, ADEA, and Section 1983 discrimination, harassment, and retaliation matters, FMLA leaves issues, and FLSA and state law wage situations. He also assists his clients in whistleblower claims and non-compete, non-solicitation, trade secret, and contract disputes. With regard to general corporate matters, he prepares employment agreements, operating and shareholder agreements, restrictive covenant (non-compete, non-solicitation, confidentiality) agreements, and business contracts.
    Scott also brings his expertise as a Florida Supreme Court Certified Circuit Civil Mediator to facilitate a resolution as an alternative to lengthy and expensive litigation. He is the immediate past Chair of the Florida Bar's Labor and Employment Section, Scott has been extremely active in helping formulate and implement legal policy on both the state and local level. He is admitted to practice in all state and federal courts in Florida, Georgia, and the District of Columbia, including U.S. District Courts for the Southern and Middle Districts of Florida.
    In 2022, Scott was again recognized as a Florida Super Lawyer in labor and employment law. In 2020-2022, Naples Illustrated named Scott a “Top Lawyer”. Previously, he was recognized by Atlanta Super Lawyers as a “Rising Star” in labor and employment law. While attending law school, Scott was elected Editor-in-Chief of the Florida Journal of International Law and was awarded the President’s Award for outstanding service to the University. He now serves on the College of Law’s Alumni Council.                                    

    Melany Hernandez is an associate in the firm’s Business Litigation Department, with a focus on employment litigation. She served as an intern in Henderson Franklin’s 2021 Summer Associate program, where she displayed a keen understanding and appreciation for the law. She devotes herself to seeking and studying legal remedies that will result in the most favorable outcome for her client. Melany is admitted to practice in all Florida state courts.
    Melany is a first-generation American born to Colombian immigrant parents who had an American dream. That dream has inspired Melany her whole life, and she knew from a young age that she wanted to help people. During her time at Florida Gulf Coast University, she realized her passion was to be a part of the American legal system. Since then, she has had the honor of working two years as the District Representative for former U.S. Congressman Francis Rooney, externing for U.S. Magistrate Judge Anthony Porcelli of the Middle District of Florida, and serving on the editorial board of the Fort Myers News Press representing the voice of young adults in Lee County.
    Melany excelled at Stetson University College of Law, where she graduated cum laude at the top of her class and was a member of the law school’s elite Dispute Resolution Team. Her moot court team prevailed over 20 teams hailing from 13 countries in the prestigious Richard DeWitt VIS Pre-Moot Competition. Melany also served as President of the law school’s Hispanic Bar Association. As a result of her pro bono work with Gulfcoast Legal
    Services’ immigration department, she was named a finalist for the Florida Bar’s William Reece Smith Jr. Pro Bono Showcase. Upon graduation, Stetson recognized Melany’s contributions to its community by awarding her its Stephanie A. Vaughan Excellence in Advocacy Award, which is presented to the law student who best exemplifies
    commitment to excellence, in and out of the classroom, and who displays tireless dedication to achieving outstanding advocacy.
